Terms & Conditions
1. Introduction
1.1 These terms and conditions ("General Terms") are the overarching general terms and conditions that apply to all the online gaming events controlled by Cutify Media & Marketing (Pty) Ltd. t/a Cute Couple SA ("the Promoter"), (the "Event" or collectively, "Events", as applicable) and accessed using the relevant Promoter website per Event ("Website"), where these should be read with, and to include, all of the other Promoter Rules or Policies applicable from time to time.
1.2 The terms "user", "you" and "your" are used interchangeably and refer to all persons accessing the Website for any reason whatsoever, including each user who participates in an Event as a couple ("participating couple" or "participant") or accesses the Website as a supporter ("supporter") and/or votes in an Event ("voter"). Accordingly, the terms "us", "our" or "we" used refers to the Promoter or its possession.
1.3 User Categories and Supporter Tiers: Users are categorised as (i) participating couples (entry into the Event) and (ii) supporters (who may vote). Supporters may be classified by the Promoter into tiers, which currently include Free, Classic and Premium, as displayed on the Website and/or in the applicable Event Rules. Classic and Premium supporter tiers may be subject to payment in order to access higher daily vote values and the ability to redeem bonus codes, as described on the Website and/or in the applicable Event Rules.
1.4 We may change these General Terms, or our other applicable policies, at any time. You should check our Website regularly for any changes which will apply from the date that they are uploaded. For further information in relation to any applicable rules, please contact support@cutecouple.co.za. It is solely your responsibility to ensure that you are aware of, have read and understood any changes as and when they become applicable; where we are under no obligation to ensure that you have done so.
1.5 By using the Website or entering any Promoter Event you agree that you have read, understood and agree to be legally bound by these General Terms and any other applicable Promoter policy or rules related to the Events, where any infringement thereof by a participant or voter constitutes a serious breach entitling the Promoter to terminate a user's participation, or voting in an Event or Events, or the use of the Website.
1.6 Please pay specific attention to the BOLD paragraphs of these General Terms. These paragraphs or statements limit the risk or liability of the Promoter or a related third-party, constitutes an assumption of risk or liability by you, impose an obligation by you to indemnify the Promoter or is an acknowledgement of any fact by you.
2. Eligibility to Our Events
2.1 The Promoter will publish separate Rules per Event which will be available on the relevant Website page where necessary and should be read and understood to identify any specific eligibility requirements per Event, in addition to these General Terms or the Promoter's other policies.
2.2 Entry to our Events is only open to South African residents.
2.3 Participants (those completing the online entry form) must be 18 years or older as well as have the requisite legal capacity to enter into a binding agreement on the date of entry.
2.4 Age limits of participants (those taking part in the Event) and other entry requirements are indicated on the Rules page.
2.5 It will be the sole decision of the Promoter as to whether any eligibility requirement has or has not been met and may require evidence or confirmation of certain information from participants before awarding prizes.
2.6 Employees (and their immediate families including any live-in partner) of the Promoter, companies within the Promoter's group of companies, and/or those associated with the operation or promotion of the Event including without limitation the provider of the prize, are ineligible to enter or vote in any of our Events. Any such entries are invalid.
3. Entry and Voting Methods
3.1 Introduction: Unless otherwise stated in any applicable Event Rules, participation in (and entry into) our Events is subject to payment of the applicable entry/participation fee(s) as determined by the Promoter from time to time and published on the Website and/or the relevant Event Rules ("Entry Fee(s)"). The Entry Fee(s) may be paid via the payment methods made available on the Website from time to time, and may include (without limitation) payment by debit or credit card.
The applicable Entry Fee(s) are as follows: R375.00 per couple, excludes other limited specials or offers.
3.2 Voting: Voting in an Event may be carried out in the following ways, as enabled on the Website and/or set out in the applicable Event Rules: (i) daily free votes; and/or (ii) redeeming a bonus code. Voting is free of charge for Free supporters and no fee is levied nor collected by the Promoter in respect of casting votes, except that your mobile network service provider and/or internet service provider may charge you for SMS, data, airtime, connectivity and/or other third-party usage costs associated with accessing the Website, which charges are not levied nor collected by the Promoter. Classic and Premium supporter tiers may be subject to payment in order to access higher daily vote values and the ability to redeem bonus codes, in each case as described on the Website and/or in the applicable Event Rules. Classic supporter charge is R99.00. Premium supporter charge is R149.00.
3.3 Deficient entries: In all Events, we reserve the right to reject any entries that are incomplete, incomprehensible, damaged or otherwise deficient. We also reserve the right to reject entries that are unlawful, indecent, racist, inflammatory, defamatory or which we consider to be otherwise harmful to the goodwill and reputation of our website and the Event in question. We accept no responsibility for any late, lost or misdirected entries, including but not limited to, texts, calls or emails not received due to technical disruptions, network congestion or any other reason. Proof of posting of any postal entry will not be proof of our receipt of that entry.
3.4 Automated Entry: The use of any automated entry software or any other mechanical or electronic means that permits any person to enter any Event repeatedly is prohibited.
3.5 Names: Participants must enter Events using their legal name once only. We reserve the right to disqualify any participant who uses multiple names and to require them to return any prize they may have won.
3.6 Multiple Entries: Unless otherwise permitted pursuant to any terms, no person may enter any Event more than once and persons may not enter or participate as part of a syndicate or on behalf of any other person, syndicate, group, society or company.
3.7 Prize Limits: No person or persons at the same residential address may win more than one prize valued at R3,000 or more via any of our Events in any three (3) month period.
3.8 Retrospective Effect: Where a participant or prizewinner has been found to be in breach of any of the terms and conditions of an Event and, in particular, where a person is in breach of the entry restrictions, we may nevertheless still enforce our right to disqualify that person and require the return or reimbursement to us of any prize, even where a prize has already been awarded and/or actually provided to the participant or prizewinner in question.
3.9 Extreme Voting: Free voting is subject to reasonable fair-use limits, anti-fraud measures, and any restrictions or caps stated in the applicable Event Rules (including limits per account, per mobile number, per IP address and/or per day/month), or as may be set forth in these General Terms. The Promoter reserves the right to determine, in their sole discretion, whether extreme, excessive, or otherwise suspicious voting measures have been taken, or where voting manipulation is reasonably suspected to have occurred.
The Promoter shall be entitled to: 3.9.1 validate votes, 3.9.2 reject or disallow votes that are incomplete, invalid, suspected to be automated or fraudulent, or otherwise in breach of these General Terms and/or any applicable Event Rules; 3.9.3 remove and/or disqualify any participant and/or voter where extreme voting or vote manipulation or artificial amplification has occurred; and/or 3.9.4 take any other action, measure, or step that it deems necessary (in its sole discretion) to protect the integrity of the Event.
4. Prizes
a. Event Prizes
1x Grand Prize valued at R100000 (one hundred thousand Rand) and includes; a 7-nights all inclusive stay for 2 at Victoria Beachcomber Resort & Spa in Mauritius; return economy flights with Air Mauritius from Johannesburg OR Tambo International Airport to Sir Seewoosagur Ramgoolam International Airport; airport transfer in Mauritius; R10,000 (ten thousand Rand). The prize does not include transfers to Johannesburg OR Tambo International Airport and/or accommodation in Johannesburg should overnight stays be required and/or travel insurance. Travel dates are confirmed as Saturday 03 October 2026 until Saturday 10 October 2026 (inclusive). Outbound flight departs at 13:10 03 October 2026. Return flight departs 08:50 10 October 2026.
The top 10 (ten) couples will receive R5,000 (five thousand Rand) per couple in cash.
The top 25 (twenty-five) couples will receive R2,500 (two thousand five hundred Rand) per couple in cash (please note that this only applies to couples in positions 11 - 25, the top 10 couples will not receive the top 25 prize in addition to their top 10 prize).
The top 250 (two hundred and fifty) couples will receive a complimentary entry into the next iteration of the Event in October 2026.
b. General Prizes
i. Twelve (12) cash prizes of R1,500 (one thousand five hundred Rand) will be awarded as a "Supporter Prize" three (3) times per week during June 2026. Draw dates and winners will be displayed on our social media and website.
ii. The Promoter reserves, in all cases, the right to replace the stated prizes with prizes that we consider to be of broadly equivalent value. We offer no cash alternative for non-cash prizes and prizewinners must accept prizes in the form offered.
iii. All prizewinners will be notified that they have won a prize within 10 (ten) days of the closing date of the Event via telephone, email or in writing. Prizes will be dispatched to the winners via an independent courier service, unless otherwise stated. We will not be liable for any prizes which are lost, delayed, or damaged in the post for reasons beyond our control.
c. Prizes will only be delivered to an address within South Africa. Should a prizewinner's contact details change from what is captured by the website, it is their responsibility to notify us in writing at support@cutecouple.co.za.
d. We reserve the right to request proof of a prizewinner's identity in the form of an identity document or driver's license or valid passport for travel and proof of address in the form of a utility bill. In the event that a prizewinner cannot provide us with proof of identity or address reasonably acceptable to us, we may withdraw the prize and select another prizewinner. This is done for authentication and security reasons.
e. All prizes are subject to availability, and are non-transferable and non-exchangeable. No cash will be awarded in lieu of any prize or part of any prize.
f. Any tax payable as a result of a prize being awarded or received will be the responsibility of the winner. Winners should seek independent financial advice prior to accepting a prize if this is a concern. The Promoter shall not be required to provide any such advice, and disclaims any liability that a prizewinner might incur as a result of following such independent third-party advice.
g. We make no representation or warranty in relation to prizes provided and to the fullest extent permitted by law we shall have no liability to you in relation to any prize, its fitness for purposes, merchantability or otherwise.
h. All stated prize values are at the supplier's recommended retail price in Rands and are correct at the time of printing. We take no responsibility for any fluctuations in prize values. We may award cash prizes in the form of vouchers in the name of the prizewinner. Any other arrangement will be at our discretion.
i. No additional, further or other costs or expenses are included in any prize unless stated. For example, the costs of couriering the vouchers to the prize recipient will be for the account of the Promoter. Any such additional costs to be incurred by a prizewinner will be detailed to them when applicable, and it is up to their discretion to accept them or not, understanding that any failure to accept a charge may result in the prizewinner no longer having the prize being delivered to them.
j. Prizes awarded in the form of cash will only be deposited into a South African bank account. Proof of identity and validity of the bank account will be requested before the release of any cash prize.
k. Unclaimed Prizes: i. All prizes must be claimed within twenty-one (21) days of our notification of winning unless otherwise stated. ii. We reserve the right to award prizes unclaimed after this period to alternative prize winners or not to award them at all. iii. If you call to claim a prize from a "withheld/private number" line you must provide us with your contact details, otherwise we may be unable to contact you and you may, as a result, forfeit your prize.
l. Cash prizes will be paid within 10-15 working days of being notified and once the correct paperwork has been received. If applicable, a payment schedule may apply, which schedule will dictate how a cash prize award will be awarded in tranches over a set period of time.
5. Refunds
5.1 Entry Fee refund policy (CPA compliance): Where an Event requires payment of Entry Fee(s), the following refund policy applies, subject always to your rights in terms of the Consumer Protection Act, 68 of 2008 ("CPA") and any other applicable law.
5.2 We will provide a refund of Entry Fee(s) paid by you if the Event is cancelled or terminated by us, as contemplated in these General Terms (including clause 11.2), and you are a non-infringing participant. Where an Event is deferred or postponed as contemplated in clause 12 below, any Entry Fees paid by you will be applied towards your entry into the next iteration of the Event following the deferral or postponement, and will not be refunded. Should you require a refund in the circumstances of deferral or postponement of an Event, such refunds will be dealt with in accordance with clause 5.3 below.
5.3 If you cancel your participation after submitting your entry, no refunds of Entry Fee(s) will be provided, except to the extent that a refund is required under the CPA (including, where applicable, in circumstances of material non-performance by us, failure to supply, or any other circumstance where the CPA gives you a right to a refund). Any approved refund may be subject to a reasonable cancellation and/or administration charge permitted by the CPA and, where applicable, any direct third-party payment processing fees that are not recoverable by us.
5.4 Refunds (where approved) will be processed using the same payment method used to pay the Entry Fee(s) where reasonably possible, or otherwise by EFT into a South African bank account in the name of the participant. We may require reasonable verification (including proof of identity and bank account details) before processing any refund, and we may refuse to pay a refund into a third-party account.
5.5 No refund will be due where we have rejected, removed and/or disqualified an entry or participant due to a breach of these General Terms and/or any applicable Event Rules (including fraud, vote manipulation, misuse of the Website, or any other infringement).
5.6 All refund requests and refund-related queries must be submitted in writing to support@cutecouple.co.za together with reasonable proof of payment and sufficient information to identify the relevant entry.
6. Publicity & Personal Information
6.1 The Promoter collects personal information ("PI") in order to conduct the Events and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as outlined its Privacy Policy.
6.2 In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages via SMS or email or telephoning the participant/voter.
6.3 All participants may have their details removed from our database by contacting the Promoter. If details are removed prior to the conclusion of the Event and/or award of prize(s), participants will however forfeit their right to claim any prizes.
6.4 It is a condition of your entry to our Events that we have the right to publicise, broadcast and communicate to the public the names, home towns, images, and characters of participants to our Events for the running of the Events and matters incidental to the Event.
6.5 In particular, participants consent to their entries to our Events being communicated to the public via publication on our Website/s.
6.6 All participants, and particularly prizewinners, may be required by us to participate in photo, recording, video and/or film session(s). In this regard, you agree that we shall have the right to use all the resulting publicity materials in any medium (including, without limitation, publication on social media and the internet) and in any manner we see fit, unless you advise us at the time of entering the Event that you wish to retain your anonymity.
6.7 Participants also acknowledge that publicity materials featuring them may be provided to our third-party prize providers for the purposes of promoting their association with the Event and awarding the relevant prizes.
7. Receipt and Transmission of Data Messages
7.1 Data messages, including e-mail messages, sent by you to the Promoter will be considered to be received only when acknowledged or responded to.
7.2 Data messages sent by the Promoter to you will be regarded as received when the complete data message enters an information system designated or used for that purpose by the recipient and is capable of being retrieved and processed by the recipient.
7.3 The Promoter reserves the right not to respond to any e-mail or other data message which contains obscene, threatening, defamatory or otherwise illegal, unlawful or inappropriate content, and to take appropriate action against the sender of such e-mail or data message where necessary.
7.4 Whilst all reasonable care is always used by the Promoter, messages sent over the internet cannot be guaranteed to be completely secure as they can be intercepted, lost or corrupted. The Promoter is therefore not responsible for the accuracy of any message sent by email over the internet, whether from the Promoter to a user or from a user to the Promoter.
8. Photographs & Videos
8.1 Should any Event require participants to submit a photograph and/or video clip, as a part of entry into or participation and used in the Event (collectively, "Photograph(s)").
8.2 Participants warrant that they are the legal owner/rights-holder of the Photograph (and the contents therein) and that it may be submitted as part of their entry; participants agree that we have the right to publish and communicate to the public the Photographs in any media including, but not limited to, online, at all times without restriction or limitation throughout the world and not only for the purposes of the Event; participants acknowledge that we may edit the Photographs in our sole discretion; and participants agree that we have the right to use participants' names, likenesses and other personal information in conjunction with the Photographs.
Participants indemnify the Promoter and hold it harmless from and against any liability (including legal costs) that the Promoter may incur as a result of the participant submitting a Photograph that they are not the lawful owner and/or rights-holder of; participants unconditionally waive their right to seek or obtain an interdict to prevent or restrict our use of the Photographs; and a third party is unable to submit an entry on behalf of another person unless they have written consent, from at least one legal guardian.
9. Draws
9.1 Where any prize is awarded via a prize draw, prizewinners will be chosen at random from all qualifying entries within twenty-eight (28) days of the Event closing date.
9.2 The Promoter makes use of a verification service to authenticate the legitimate and correct determination of prizewinners. Where the Promoter is required to adhere to legislation regarding the verification or authentication of prizewinner determination, the Promoter undertakes to do so.
9.3 If we become aware that the same person has been selected as a prizewinner more than once, we will draw another name.
10. Copyright
10.1 By entering our Events, all participants assign to us all rights (including present and future copyright) in their entry and publicity materials; agree not to assert any moral rights against the Promoter; warrant that their entry is not in breach of any third-party intellectual property rights; and warrant they have the authority to grant rights set out in these General Terms.
10.2 All rights in the name and title of the Event and the format rights for the Event are our sole property and we may exploit the same our absolute discretion.
10.3 All material, information, data, software, icons, policies, text, graphics, layouts, images, sound clips, advertisements, video clips, trade names, logos, trade-marks, designs, copyright and/or service marks (as well as the organisation and layout of the Website) of the Website and/or Event, together with the underlying software code of the Website and/or Event, ("the intellectual property") are owned (or co-owned or licensed, as the case may be) by the Promoter, its members, associates and/or partners.
10.4 Subject to rights afforded to you in these General Terms or by separate written agreement between the Promoter and you, all rights to intellectual property on the Website and related to an Event are expressly reserved by the Promoter or the relevant rights owner.
11. Tampering and Other Matters
11.1 If for any reason any Event is not capable of running as planned as a result of technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of an Event, we reserve the right to cancel, terminate, modify or suspend the Event and/or any draw/s or judging related to the Event and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.
11.2 Where we exercise the rights to cancel or terminate an Event as reserved under clause 11.1 above, we will take one of the following measures: 11.2.1 grant non-infringing entrants a free entry into the immediately following iteration of the Event and count votes already submitted; or 11.2.2 refund entry fees paid by such non-infringing entrants, subject to reasonable verification requirements.
12. Deferral / Postponement of Event and Termination of User Access
12.1 The Promoter may vary the terms of, defer, or postpone, an Event at any time at its absolute discretion without liability to any contestant or other person, to the full extent permitted by applicable legislation.
12.2 The Promoter reserves the right to terminate and cancel your account and use of the Website or involvement in any Event if you breach any of these General Terms or the Promoter's other applicable Rules or Policies, or for any other reason provided that the Promoter gives reasonable notice to you with written reasons for the cancellation.
12.3 If you wish to terminate your agreement with these General Terms and with the Promoter, you may do so by deregistering your account with the Website and discontinuing use of the Website. However, no termination will affect rights to payments lawfully due under these General Terms at the time of termination.
13. Decisions Final
13.1 All our decisions relating to the Event and/or redemption of prizes are final. No discussions or correspondence relating to the Promoter's decisions will be entertained.
13.2 Tiebreakers, voting methods and winner selection: voting may be cast either by using daily free votes or by redeeming a bonus code (where available).
13.3 Users are categorised as either participating couples (entry) or supporters.
13.4 Supporters may be Free, Classic or Premium; Classic and Premium supporters may pay to access higher daily vote values and the ability to redeem bonus codes (as applicable).
13.5 Winners (other than any Grand Prize) are determined by the couples receiving the most votes during the Event. If two or more couples are tied on votes for any placement (including where a prize is awarded), the couple's Unique ID will be used as the tiebreaker, with Unique IDs reflecting registration order and determining ranking.
13.6 If a Grand Prize is offered, the Promoter and its headline sponsor(s) if applicable, will select the Grand Prize winner from among participating couples placed in the Top 25 at the end of the Event using a weighted criteria matrix.
13.7 Any tiebreakers, disputes, conflicts, questions or concerns will be managed by us and, if required by law, by an independent adjudicator.
13.8 Where an Event involves voting, the accuracy of pooled results received and published by us will be deemed final and binding and no correspondence discussing this will be entertained.
13.9 Prizewinners are verified by an independent and objective verification provider ("Verifier"), who performs this function in strict accordance with applicable laws and regulations.
14. Exclusion of Liability and Indemnities
14.1 The Website, including any intellectual property appearing therein, is provided "as is" and "as available". The Promoter makes no representations or warranties, express or implied, including but not limited to warranties as to the accuracy, correctness or suitability of either the Website or the information contained in it.
14.2 All information or opinions of users or third parties made available on the Website in relation to any of the Events or otherwise, are those of the authors and not the Promoter.
14.3 The use of the Website, entering or voting in any Event may use services or functions of third-party providers and the Promoter will not be held liable to a user if such third-party functions or services malfunction.
14.4 The Promoter, its shareholders, employees and partners, accept no liability whatsoever for any loss, whether direct or indirect, consequential or arising from information made available on (or by means of) the Website and/or transactions or actions resulting therefrom.
14.5 The Promoter, its shareholders, office-bearers, employees, partners and affiliates, accept no liability whatsoever for any costs, expenses, fines or damages resulting from awarding of prizes, entering or voting in any Event, and access to, or use of, the Website.
14.6 The Promoter takes reasonable security measures to ensure the safety and integrity of the Website; however, it does not warrant uninterrupted or error-free access. The user's access to and use of the Website remains solely at the user's own risk.
14.7 The user indemnifies and holds harmless the Promoter, its shareholders, employees, and partners from any demand, action or application or other proceedings made by any third party and arising out of or in connection with the user's use of the Website or entering or voting in any Event.
14.8 The user agrees to indemnify, defend and hold the Promoter harmless from any direct or indirect liability, loss, claim and expense (including reasonable legal fees) related to the user's breach of these General Terms or any of the Promoter's other applicable Rules or Policies.
15. Prize Sponsors
At the time of entering any Event you will be asked if you would like to be automatically opted-in to be added to the headline sponsor's database, which you can accept or reject in your discretion. For further information in this regard, please see our Privacy Policy.
16. Dispute Resolution
16.1 Should any dispute, disagreement or claim arise between a user and the Promoter concerning use of the Website or any matter relating to an Event, the parties shall endeavour to resolve the dispute amicably, by negotiation, and with the best interests of both parties in mind. Should the parties fail to resolve such dispute, it shall be resolved with the assistance of and in accordance with the Rules of the Arbitration Foundation of Southern Africa by an arbitrator appointed by the Foundation.
16.2 The parties both agree that in no circumstance will either party publicise the dispute on any social media or other public platform.
17. General
17.1 For formal service of any notices or documents to the Promoter, same may be sent to support@cutecouple.co.za whereas the service address for any user is deemed to be the information submitted by you on the Website for this purpose.
17.2 The Promoter does not guarantee that the Website, or any portion thereof, will function on any particular hardware or device.
17.3 This document contains the entire agreement between the parties in relation to the subject matter hereof.
17.4 No indulgence, leniency or extension of time granted by the Promoter shall constitute a waiver of any of the Promoter's rights under these General Terms.
17.5 Headings are inserted for reference purposes only and will not affect interpretation of any provisions.
17.6 The user's access and/or use of the Website, any downloaded material from it and the operation and interpretation of these General Terms (including entering or voting in an Event) shall be governed by and construed in accordance with the laws of South Africa only.
17.7 In the event of the user breaching these General Terms or any other applicable Rules or Policies, the user shall be liable for all legal costs (on the scale as between attorney and client) that may be incurred by the Promoter in relation to, and as a consequence of, the breach.
17.8 Each sentence, paragraph, term, clause and provision of these General Terms and any portion thereof shall be considered severable and if held to be invalid, contrary to, or in conflict with any applicable law, it shall to that extent be deemed not to form part hereof and shall not impair the operation of the remaining valid provisions.
17.9 No term or condition of these General Terms is intended to breach any peremptory provisions of any consumer protection or other legislation and regulations thereto ("Prohibited Provision"). Any breach of any such Prohibited Provision shall be governed by clause 17.8 mutatis mutandis.
